1. MYOS® PROPRIETARY

MAKE YOUR OWN STYLE, a sole proprietorship, with headquarters at Avenida da República No. 1326, 9th floor, Room 95, 4430-192 – Vila Nova de Gaia, Portugal, with tax ID number 513 308 580, registered with the Commercial Registry Office of Vila Nova de Gaia, is the legitimate owner of the website and the MYOS® brand.

3. SCOPE

  • These Terms and Conditions are intended to govern exclusively purchases and exchanges made on the MYOS® online store, between the store and the customer;
  • Browsing the website, as well as making purchases, implies acceptance of the Terms and Conditions in effect;
  • MYOS® reserves the right to modify, without notice, any information contained in the online store, including images, product information, terms of sale, prices, and promotions. For changes to the Terms and Conditions, MYOS® must first provide notice on the website;
  • MYOS® reserves the right to cancel an order if the customer’s information is invalid or if the customer does not accept the Terms and Conditions;
  • The customer declares that all personal information provided is true;
  • When a purchase is made on the MYOS® online store, the customer declares that they are of legal age and have the legal capacity to enter into purchase and sale contracts.

4. COPYRIGHT

This website is protected by copyright laws and all rights are reserved, except where expressly provided. Individual documents may contain different copyright notices and/or additional proprietary notices. If you believe your work has been copied in a way that constitutes copyright infringement, please notify MYOS® of any claims of copyright infringement.


5. CONTENT AND ONLINE STORE

  • All items available in the online store are intended for personal use, and their sale or storage without prior authorization from the brand is strictly prohibited;
  • If you find references or links related to our online store on other websites, please note that we assume no responsibility for them.


6. SALES POLICY

  • The images shown are for illustrative purposes only. Customers should not make a decision based solely on the image. If there are any questions regarding the product’s features shown in the image, customers should contact the brand through Customer Support;
  • Product prices and specifications are subject to change, and MYOS® is responsible for all information provided. If the customer has been adversely affected by such a change (in the case of a purchase not paid for on the same day), they have the right to contact MYOS® Customer Support;
  • The online store catalog is independent of the catalog available in physical stores in terms of prices, promotions, and current stock;
  • All data recorded by MYOS® constitutes evidence of transactions occurring between the brand and the Customer;
  • The purchase and sale contract will only be formalized when the customer accepts the MYOS® Terms and Conditions and completes the order in the online store.


7. ONLINE ORDERS

  • To place an order through the MYOS® online store, customers must register online;
  • To place an order at www.myos.eu, you must register using the online form and provide all accurate information. Once the process is complete, simply add the desired items to your shopping cart and complete the payment using: the 3x or 4x Oney payment plan, credit or debit card, Multibanco reference, MBWAY, or PayPal.

 

8. PRODUCT AVAILABILITY / ORDER REFUSAL

  • he fulfillment of all orders placed through the MYOS® online store is subject to current stock levels. MYOS® strives to ensure that all items are available for sale;
  • In the event of stock unavailability, MYOS® reserves the right to inform the customer that they are entitled to a refund of the amount in question;
  • MYOS® may refuse an order if payment has not been made or the order is incomplete; in such cases, an email will be sent to the customer explaining that the purchase agreement has not been concluded.


9. PAYMENT TERMS AND PAYMENT GUARANTEES

  • All available payment methods are displayed once the order is completed. We cannot accept any payment method not listed;
  • Please note that we do not accept any payment methods other than those listed at checkout. Specifically, these include the 3x or 4x Oney installment plan, credit or debit card, Multibanco reference, MBWAY, or PayPal.


10. MYOS® SECURITY AND TRANSACTIONS

The MYOS® online store uses the latest and most robust security technologies available for encryption platforms. All payment data will be encrypted from the moment the transaction begins until it is processed.


11. PRICING POLICY

  • All prices displayed on www.myos.eu include tax (VAT);
  • The total amount at the end of the order includes taxes and shipping costs;
  • The shipping fee will depend on the order’s destination. Prices are in euros, and any change in the delivery country may affect the final amount due to shipping costs.

12. ORDER SHIPPING AND DELIVERY POLICY

  • Products ordered from the MYOS® online store will only be shipped and delivered on business days;
  • We can only guarantee proper delivery of an order if the address provided by the customer is correct and corresponds to a specific physical location (such as a home or office). If the address provided by the customer is incomplete and the order is returned to the sender, the customer will be required to pay the shipping costs again;
  • A returned order will only be reshipped after it has been received by MYOS® and the customer has paid the shipping costs again.


13. ORDER DELIVERY TIMES

Upon receipt of the order and verification of in-store stock, MYOS® commits to the following delivery times:
  • In Portugal, within a maximum of 5 business days;
  • In the archipelagos of Madeira and the Azores, between 5 and 10 business days;
  • In the European Union (excluding Portugal), approximately 15 business days;
  • In all countries outside the European Union, within 20 business days.

 

14. ORDER CANCELLATION POLICY

The Customer may cancel an order before MYOS® ships it, that is, before the order status changes to “completed.”


15. PRODUCT QUALITY AND WARRANTY

  • MYOS® sells only high-quality products and is responsible for any discrepancies in this regard. It never sells second-hand products, products with quality defects, or products of inferior quality compared to market standards;
  • The colors of the products displayed in the MYOS® online store may not match the original colors. This discrepancy may be caused by different browsers or the brightness of the customer’s screen.


16. PROMOTIONAL CODES

  • Promotional codes apply only to a selected item or group of items specified in the MYOS® online store, allowing the customer to take advantage of the promotion/discount within the timeframe set for that specific promotional code;
  • Promotional codes are personal and non-transferable, cannot be combined with other promotions, and may only be used in the MYOS® online store;
  • Promotional codes cannot be exchanged for cash, and the value in question will not be refunded;
  • It is prohibited to use promotional codes for commercial purposes;
  • MYOS® reserves the right to invalidate promotional codes if the rules described above are violated.


17. GIFT CARD

  • The MYOS Gift Card is a prepaid gift card that can be used as a payment method at all MYOS stores. The minimum and maximum loading limits for this card are €10 and €1,000, respectively. The card balance is valid for 1 year from the date of purchase, which is printed on the back of the card. Once the expiration date has passed, the total or remaining balance on the card cannot be refunded or used;
  • Loss or misplacement of the card: MYOS is not responsible for the loss or misplacement of the gift card. MYOS is not responsible for any existing balance used by another person;
  • The card can be used to purchase any item for sale at any MYOS point of sale. The gift card cannot be purchased using another gift card;
  • The purchase and/or use of the card constitutes acknowledgment and acceptance of the respective general terms and conditions, which were provided at the time of purchase and are available at MYOS stores and/or at www.myos.eu


18. RESPONSABILIDADE SOCIAL

  • MYOS® is not liable for any damage suffered or caused by the improper use of any of our products;
  • All products sold by MYOS® comply with Portuguese and European Union law;
  • MYOS® disclaims any liability in the event of a violation of the laws of the country where the order is delivered. It is the customer’s responsibility to verify with the local authorities of the country in question the conditions for importing or using the products they wish to order.


19. INTELLECTUAL PROPERTY

  • The names, trademarks, and logos on www.myos.eu are protected in accordance with the legal provisions applicable to the protection of industrial and intellectual property;
  • It is strictly prohibited to use any information or materials found on the MYOS® online store for commercial purposes without prior written authorization from MYOS®.


20. GOVERNING LAW

  • These Terms and Conditions and the use/purchase on the MYOS® online store are governed by Portuguese law;
  • In the event of a dispute regarding the interpretation of the Terms and Conditions, MYOS® is willing to negotiate an amicable settlement within 30 days of receiving a registered letter;
  • If an agreement cannot be reached and the parties are unable to comply with the Terms and Conditions in force, both parties must bring the matter before the District Court of Porto.
